This website is owned and maintained by Mashy Marketing, LLC (“MASHY”). By using this website, you are entering into this Agreement with MASHY and indicating that you agree to these terms and conditions. If you do not agree with these terms and conditions, please do not use this website. You can contact us if you have any questions.
Scope of Service
We offer a free proposal to provide you with a breakdown of the services and costs of those services. Some services are listed on our website as monthly packages. Other services are project-based services. MASHY shall provide only those professional services specified in the Marketing Agreement and the Standard Terms and Conditions (collectively referred to as the “Agreement”) as agreed to by Client and MASHY. If Client requests and MASHY agrees to perform any services that are in addition to or outside the scope of Work identified in the Agreement, Client shall promptly pay MASHY for such services in accordance with the terms and rates shown in the Agreement.
We do hold the right to refuse service to anyone.
Results & Guarantees
We are a very honest group of people. We strive to work hard and effectively to get you the results desired, but we do know that not every idea works for every business. We therefore want to let you know that we can never guarantee any success and that by working with us, you agree and understand that there are no guarantees.
You understand and agree that you are paying MASHY as a service to generate results but that results are never guaranteed. It is understood and agreed to that MASHY has no control over other media platforms, and if they decide to make changes to their platform.
You understand and agree that there are no refunds. Once payment has been made, you can never claim it back, neither full nor partial.
All material on this website is copyright of MASHY unless otherwise specified. All of the materials we post on our blog or send out are meant as educational and informational material that we do not guarantee the success of, if being implemented.
Use of this website is at your own risk. You assume full responsibility and risk of loss resulting from the usage of, or downloading of, information, files, content, material, or other communications through this website.
You may use the material we provide for personal use. You may not resell or redistribute this information or material without the express written consent of MASHY.
Month to Month Agreement
Should we decide to work together, then you agree to pay your monthly payment on the date specified that payment is due. You also agree to finish the month in its entirety, even if payment for a new month has just begun.
You or MASHY may cancel the Agreement in advance by delivering written Notice of Cancellation to the other party at the address provided or via email to an authorized representative at least thirty (30) days prior to the requested cancellation date.
We store your information such as name, phone number, and e-mail privately. Your payment information is stored in an encrypted version that cannot be used for anything else other than payment for MASHY services and products.
Hold Harmless & Indemnification
You, the client company, and its affiliates, officers, representatives, employees, agents, executors, administrators, successors or assigns (“Client Parties”), agrees to indemnify, defend and hold MASHY and MASHY’s present and future officers, directors, employees, shareholders and agents (the “Indemnified Parties”) harmless from and against any and all liabilities, penalties, fines, forfeitures, demands, claims, causes of action, suits, losses, damages, and costs and expenses incidental thereto (including, but not limited to, all costs of defense, settlement, reasonable attorneys’ fees and other litigation expenses incurred in a judicial or administrative action), which any or all of the Indemnified Parties may hereafter suffer, incur, be responsible for or pay out as a result of any breach of any obligation by any of the Client Parties.
Including, without limitation, any breach of these Terms of Service, or as a result of any violation or alleged violation of statutes, ordinances, orders, rules or regulations of any governmental entity or agency, or any negligent or willful act or omission by any of the Client Parties.
